The Isle of Man’s sentences for the importation and supply of controlled drugs are significantly longer than those of England and Wales save for one very limited and lesser known exception. Where there is an importation of a very small quantity for personal use, the sentence is equivalent to the offence of simple possession of the drug. In the leading case of Mitchell v AG, 2DS 2021/13 the Appeal Division applied the principle to Mr Mitchell. He had imported 1.6g of cocaine and 9.2g of cannabis for his personal use. Mr Mitchell was a young and employed Welsh tourist with no previous convictions. His original sentence of 3 years and 4 months was reduced to 6 months on appeal.
