In the Appeal Division’s recent decision in Madden v AG, the Appeal Division updated the law. The law was previously that offences of the importation and supply of controlled drugs, where they were for personal use, were to be sentenced in the same way as possession of the same drug. The Appeal Division held that the exception only applied to the importation of very small quantities for personal use, it did not apply to the supply of controlled drugs. Such arguments, it held, should be given short shrift.
