Northern Ireland Court of Appeal’s guidelines on credit for guilty pleas are lawful

In the Supreme Court’s decision in R v Maughan [2022] UKSC 13 it upheld the Court of Appeal of Northern Ireland’s guidance on the credit for guilty pleas. The Court upheld its guidance on the stage of the plea and the effect of overwhelming evidence.

The legislation required a Court to take into account the “stage in the proceedings” at which plea was entered. Whilst “proceedings” does not include the investigation before charge, the Court of Appeal was entitled to issue guidance based on utilitarian benefits such as administrative resources, inconvenience to witnesses and vindication and relief to victims. Therefore, the Court of Appeal was entitled to hold that the failure to admit an offence during interview was relevant to discount.

The Court of Appeal was also entitled to find that the strength of the case was relevant to discount. Where there was a strong case, a defendant may not be entitled to the same level of benefit.bThis is distinct to England and Wales where pleas at the first stage of proceedings merit a full 1/3 discount even where a defendant is caught red-handed.

In similarity to Northern Ireland, the Appeal Division (of the Isle of Man) has held that where the case is overwhelming it may not be appropriate to apply the full discount (para 38 in Birney, R v (SGD) 2014 MLR 476). However, the usual discount for a plea at the first opportunity is 1/3 (para 35, 42, Ibid.). This practice is applied in the majority of cases.

With the proposed changes to criminal procedure, there will be further opportunity to indicate pleas at an early stage. Where the opportunity to indicate/plead is not taken, full credit is lost on the current law. Advocates need to be alive to the potential loss of credit where early opportunities to plead are not taken.
